According to some proponents and critics of research using animals, the greatest hope for improved conditions for laboratory animals is to be found in the system of self-regulation called for by recent legislation and the NIH's revised policy. This article explores advantages and disadvantages of relying on "Institutional Animal Care and Use Committees" to subject research proposals to ethical scrutiny. Among the advantages discussed are: institutional dialogue concerning the ethics of research; inclusion of perspectives of nonscientists in such dialogues; and (...) the possibility of improved research proposals. Despite these advantages, I argue that serious problems with the committee system may limit the degree to which conditions for animals are actually improved. Disadvantages discussed include: limitations in the scope of the review process, and built-in bias in favor of certain philosophical stances in the composition of the committees. Contemporary professional restaurant reviews have consequences beyond the dinner plate. They now face challenges from the democratizing efforts of blogs and crowd-sourced reviews. Thus an analysis seems appropriate for determining how they are written and what might be lost should they be replaced. Restaurant reviews are presumed to be a species of art and literary criticism and as such have evolved as a rhetorical genre. Through genre analysis we inductively construct the form of the professional restaurant review and then apply (...) it deductively to recent reviews to discover any substantive and stylistic differences that have arisen in the evolution of this genre of writing. We conclude with a critique of this genre that reveals ethical implications for the uses of metaphors in professional restaurant reviews. (shrink)

Patients with apraxia perform poorly when demonstrating how an object is used, particularly when pantomiming the action. However, these patients are able to accurately identify, and to pick up and move objects, demonstrating intact ventral and dorsal stream visuomotor processing. Appropriate object manipulation for skilled use is thought to rely on integration of known and visible object properties associated with ‘ventro-dorsal’ stream neural processes. In apraxia, it has been suggested that stored object knowledge from the ventral stream may be less (...) readily available to incorporate into the action plan, leading to an over-reliance on the objects’ visual affordances in object-directed motor behaviour. The current study examined grasping performance in left hemisphere stroke patients with (N = 3) and without (N = 9) apraxia, and in age-matched healthy control participants (N = 14), where participants repeatedly grasped novel cylindrical objects of varying weight distribution. Across two conditions, object weight distribution was indicated by either a memory-associated cue (object colour) or visual-spatial cue (visible dot over the weighted end). Participants were required to incorporate object-weight associations to effectively grasp and balance each object. Control groups appropriately adjusted their grasp according to each object’s weight distribution across each condition, whereas throughout the task two of the three apraxic patients performed poorly on both the memory-associated and visual-spatial cue conditions. A third apraxic patient seemed to compensate for these difficulties but still performed differently to control groups. Patients with apraxia performed normally on the neutral control condition when grasping the evenly weighted version. The pattern of behaviour in apraxic patients suggests impaired integration of visible and known object properties attributed to the ventro-dorsal stream: in learning to grasp the weighted object accurately, apraxic patients applied neither pure knowledge-based information (the memory-associated condition) nor higher-level information given in the visual-spatial cue condition. Disruption to ventro-dorsal stream predicts that apraxic patients will have difficulty learning to manipulate new objects on the basis of information other than low-level visual cues such as shape and size. BackgroundEthics consult services are well established, but often remain underutilized. Our aim was to identify the barriers and perceptions of the Ethics consult service for physicians, advance practice providers (APPs), and nurses at our urban academic medical center which might contribute to underutilization.MethodsThis was a cross-sectional single-health system, anonymous written online survey, which was developed by the UCSD Health Clinical Ethics Committee and distributed by Survey Monkey. We compare responses between physicians, APPs, and nurses using standard parametric and non-parametric statistical (...) methods. Satisfaction with ethics consult and likelihood of calling Ethics service again were assessed using a 0–100 scale using a 5-likert response structured (0 being “not helpful at all” to 100 being “extremely helpful”) and results presented using box plots and interquartile ranges (IQR).ResultsFrom January to July 2019, approximately 3800 surveys were sent to all physicians, APPs and nurses with a return rate of 5.5—10%. Although the majority of respondents had encountered an ethical dilemma (85–92.1%) only approximately half had ever requested an Ethics consult. The primary reason for physicians never having requested a consult was that they never felt the need for help (41%). For APPs the primary reasons were not knowing an Ethics consult service was available (33.3%) or not knowing how to contact Ethics (27.8%). For nurses, it was not knowing how to contact the Ethics consult service (30.8%) or not feeling the need for help (26.2%). The median satisfaction score (IQR) for Ethics consult services rated on a 0–100 scale, from physicians was 76 (29), for AAPs 89 (49), and nurses 70 (40) (p = 0.62). The median (IQR) of likelihood of consulting Ethics in the future also on a 0–100 scale was 71 (47) for physicians, 69 (45) for APPs, and 61 (45) for nurses (p = 0.79). APP’s and nurses were significantly more likely than physicians to believe that the team did not act on the Ethics consult’s recommendations.ConclusionsBased on the results presented, we were able to identify actionable steps to better engage healthcare providers—and in particular APPs and nurses—and scale up institutional educational efforts to increase awareness of the role of the Ethics consult service at our institution. Actionable steps included implementing a system of ongoing feedback that is critical for the sustainability of the Ethics service role. We hope this project can serve as a blueprint for other hospital-based Ethics consult services to improve the quality of their programs. (shrink)

Leavis’s turn from a preoccupation with poetry to a preoccupation with the novel in the second part of his career has long been recognized. There is a consensus that he had a wonderful feeling for the textual particularity of poetry, the way that a poem is not just its paraphrasable content, in that the meaning is carried by the movement, rhythm, tone, and tempo of the speaking voice. Poetry intended for the eye and print reading only passed him by. That there is something not altogether honest about a didactic novel can be seen once we imagine a novel which violates our political sympathies or our moral principles, such as a novel that shows the Nazis or the American soldiers at My Lai as heroes. We certainly would not like this novel. But could we refute it because of our certain knowledge that these men, in real life, were murderers? I don't think so, since a skillful writer could easily make (...) his characters act heroically in the situation—and even make us dislike their victims. Could we say that the situation is false? Perhaps, but since the actions and the characters are fictional, what does it mean to refute them? We can say that a novel is bad or unconvincing if the characters do not resemble people in real life or if the actions do not satisfy our sense of logic or probability. But these are literary objections, not political ones. And because the writer cannot be refuted by evidence from the real world, he cannot make pronouncements about this world. For example, even if there were evidence that no slave resembled Tom and no overseer resembled Legree, such evidence could not refute the novel Uncle Tom's Cabin. And as Moody Prior points out in his essay , our disagreement with the philosophy of spiritual, rather than physical resistance to slavery cannot take away the heroism of Tom's action. His final act of forgiveness is indeed Christ-like, and no philosophy of political activism which is validated by, let us say, our admiration for Tom within the novel cannot validate Tom's kind of inward action in the real world. If it did, then our admiration for Tom, a fictional character, would prelude our support for a more active resistance to oppression. But, of course, it does not, or at least it should not, if we are to see fiction as performing a different role than politics and philosophy. Lawrence W. I agree with much of what is said in this article; and I also will quote Roland Barthes, but for a different purpose. But I believe that it is a mistake to judge contextualism by its theory rather than its practice. If we look carefully at what is actually done in contextualist criticism, we will find that the "contradictions in its basic premises" which trouble Wasiolek have also allowed it to overcome the limitations that a strict construction of "autonomy" would (...) impose. We will also find that what really distinguished contextualism, what the concept of autonomy leads to in practice, is not an impoverishment but a deepening and enrichment of the literary experience and, third, that the theoretical developments in other critical schools have vindicated at least one cardinal principle of contextualism, namely, that the meaning of a literary work is inherently ambivalent or indeterminate. By following the lead, we can, I believe, provide a better theoretical base for contextualism, although I am not sure that it would be or should be one that "includes the world rather than excludes it," as Wasiolek demands it. Readers seeking contributions to the life of the mind find their harangues both unpleasant and unrewarding. This book is unfortunately no exception.Atwill's title is deceptive. Her work is only marginally about either Aristotle or his rhetoric. She is more concerned to "reclaim" the liberal arts held hostage by the received tradition of Athenian democratic ideals. Weber and his work functioned in two ways: both as a bridge to the new, to the world of capitalist modernity, as well as a road to an acceptable cosmopolitan ‘liberal’ historical past. It was Weber the cosmopolitan and outsider who could give legitimacy and weight to the intellectual orientations and problems thought to be significant for the community in exile. It was this Weber who could cushion the ‘negative shock’ of what was often perceived as America’s ‘intellectual and cultural (...) provincialism’ and establish for the emigre scholar and intellectual the historical task of assisting in the development of American intellectual and cultural life. At the same time, the presence of a different Weber in America, already an established interest of several scholars emerging into prominence, such as Talcott Parsons and Edward Shils, created difficulties as well as opportunities for the emigre scholars. Because of such variety the field for the transmission, reception, and influence of Weber’s work must be approached as a complicated, multilayered, and contested patchwork of disparate and sometimes partially overlapping social and professional networks. This thesis modifies the wording of William Clifford’s 1877 evidence principle (that ‘it is wrong always, everywhere, and for anyone, to believe anything upon insufficient evidence’) to propose an explicitly moral principle, restricted to descriptive beliefs (about what is or is not the case) and excluding prescriptive beliefs (about what ought or ought not to be the case). It considers potential counter-examples, particularly William James’s 1896 defence of religious belief; and concludes that the modified principle survives unscathed. It then searches (...) for suitable criteria for ‘sufficient’ and ‘insufficient’ evidence, first within a Bayesian framework enriched by pragmatic considerations, and finally by returning to Clifford’s conception of our shared responsibilities to our shared epistemic asset. Combined with elements of Edward Craig’s (1990, 1999) ‘state-of-nature’ theory of knowledge this gets us to a minimum threshold to avoid insufficient evidence and an aspirational criterion of sufficient evidence. The project of “public reason” claims to offer an epistemological resolution to the civic dilemma created by the clash of incompatible options for the rational exercise of freedom adopted by citizens in a diverse community. The present Article proposes, via consideration of a contrast between two classical accounts of dialectical reasoning, that the employment of “public reason,” in substantive due process analysis, is unworkable in theory and contrary to more reflective Supreme Court precedent. Although logical commonalities might be available to (...) pick out from the multitude of particularized accounts of what constitutes “civic order,” no “public reason” so derived could adequately capture - and thus be able to secure in a practical sense - any single determinate civic order, much less one that would be consistent with all citizens' conceptions of public order. Part I of this Article raises a number of issues for consideration relating to the epistemology of law and focuses especially on the concept of public reason and its critique. Part II addresses alternative approaches to legal reasoning suggested by classical accounts of practical reasoning and virtue theory and considers the operation of such legal analysis outside the area of substantive due process; Part III analyzes post-Lawrence case law confirming the dilemma created by the Supreme Court's ambiguous approaches to substantive due process and concludes that only one interpretation - that articulated fully in Washington v. Dr. Martin Luther King, Jr.’s philosophical legacy arises in the academy, so far, the question remains open-ended (though, as I will shortly argue, the question has already been answered by King himself). Beyond his presence in public American consciousness, King left behind speeches, sermons, correspondence, and writings that inspire both (...) philosophical and theological reflection. However, King is also interpreted on the merits of the biases and philosophical traditions that we scholars navigate. Such biases and philosophical traditions mediate our experience of encountering King, and this mediation can impact our understanding of what exactly King’s philosophical legacy is.1Accordingly, we should seek to reconstruct King’s thoughts in the philosophical vocabulary King employed rather than displacing King from his own agency and the contexts that shaped him.2 In doing so, we prevent mistakes and misunderstandings that plague the public knowledge of King’s legacy. And yet, serious misunderstanding occurs every January with light fluff pieces in major newspapers and websites from authors who do not read King’s corpus. What’s more, some scholars are guilty of this lack of reading King widely. Consider Martha Nussbaum and her glaring error and omission in her recent contribution to a recent book that purports to look at King as a philosopher: “Although a religious man, [King] did not advance in his political writings a comprehensive and religious doctrine, as Gandhi did” (Nussbaum 123). In an otherwise interesting article about political emotions, Nussbaum completely neglects any historical consideration or development where King describes himself as a personalist.3 Like others, Nussbaum disregards King’s own self-description. This disregard is tantamount to a silent [End Page 45] and implicit racism that results in scholarly efforts that deprive King of his own intellectual agency when interpreting his work. This tendency prevails in both philosophy and theology departments, and this neglect has also been the larger challenge of African American philosophy gaining more acceptance as a field of philosophical inquiry (McClendon and Ferguson 38). My efforts in this article are to put an end to continual misreadings of King. First and foremost, King is a personalist.While this essay defends the personalist interpretation of King, let me lay out briefly those pieces of evidence. The interpretation of King as a personalist rests on four evidential sources: (1) King’s own words, (2) family background, (3) influence of personalist ideas on his writings, and (4) the tradition of King’s reception by other Boston personalists. First, King describes himself in his own words as a personalist. This is perhaps the biggest piece of evidence for why we should read King as a personalist. Second, King was influenced by personalism before studying Brightman’s philosophy with Gregory Davis at Crozers Theological Seminary.4 Before Morehouse College and Crozers Theological Seminary, according to Rufus Burrow, homespun personalism emerges out of King’s upbringing within the Black Church. For this reason, scholars should not doubt that King synthesizes personalist influences with how he was raised (Burrow, God and Human Dignity 17–31). Moreover, given that King chose to go to Boston University to study with Brightman and to be where Boston personalism was known to be strong, all of these facts indicate that King was a personalist (Burrow, God and Human Dignity 24).Homespun personalism gave King a vocabulary to bring together and synthesize many intellectual forces in his life, and this synthesis is recognized by other personalists. Walter Muelder is one such personalist. Muelder was Dean of Boston University’s School of Theology from 1945–1972 when King attended. Muelder and King exchanged correspondence, and Muelder delivered many lectures, some published and others unpublished, on the personalism of King. The most famous of these lectures is one Muelder gave to Morehouse College in 1983, in which Brightman’s moral law system is read into King’s own words. Taking this historical background and also that, to this day, some teachers at Morehouse College, like Lawrence Carter, make their students learn the personalist moral law system from Muelder and Bright-man, the personalist interpretation...
